Terms Of Service

Please read these customer terms of service carefully.

This is a contract between you (the customer) and us (The Network Collective). It describes the services we will provide to you, how we will work together, and other aspects of our business relationship. This is a legal document, so some of the terms and conditions may be difficult to read and understand. We have tried to make it as easy to understand, and as short, as possible; we want to make it possible for you to read, and understand, these terms before using and during the usage of our services.

These terms are so important that we cannot provide our products and services to you unless you agree to them. By using the services provided by The Network Collective, whether free or through a subscription, you are agreeing to these terms.

We periodically update these terms. When we do, we will let you know via a notification on The Network Collective site itself.

Throughout these terms, “we” and “our” refer to the staff, personnel, and content creators of The Network Collective, while “you” refers to individual subscribers.

General Commercial Terms

The Network Collective offers access to material that, to the best of our ability, advances the careers and community of network engineers. The kinds and amount of material available to you are described in the services catalog, which can be found here. The Network Collective may decide to offer any individual free access to any subscription level at our discretion.

The Network Collective attempts to make this material available to you 24 hours a day, 7 days a week, barring preannounced downtime for regular maintenance, but no guarantee is expressed or implied about site or material availability. Neither party will be responsible for failure or delay of performance if caused by: an act of war, hostility, or sabotage; act of God; electrical, internet, or telecommunication outage that is not caused by the obligated party; government restrictions; or other event outside the reasonable control of the obligated party. Each party will use reasonable efforts to mitigate the effect of a force majeure event.

Subscriptions and Payments

Subscriptions are offered on a prepaid basis only, determined by the plan chosen. The Network Collective does not generally offer refunds, even if you stop using the service during your term of subscription.

The subscription cost is fixed for the term of service. The cost of a subscription may change on renewal.

If you decide to change your subscription level, The Network Collective will prorate the remaining value of your subscription service and discount the upgrade to the new level by that amount. The new subscription will not be prorated, but will be a full one year subscription from the time of the change.

All subscriptions are paid through the subscription web form.

Acceptable Use

You may not use our service if it you are legally prohibited from doing so by the laws where you reside or are currently located.

You will not use any automated process that accesses our services in a way that damages our ability to serve other subscribers.

You will notify us as soon as possible of any breach in your account.

You will not use your access to other subscribers for commercial purposes, such as building a list of contacts for sale to a third party or gathering a list of potential clients for another service or product. This is not meant to restrict individual interaction between the users of the service to discuss potential business or other relationships, but rather to protect our users from their information being used en masse for some purpose they did not understand nor anticipate when signing up. Access to the material is made available to the subscriber only; you may not share any material obtained through a paid subscription plan with others, nor may you share your user account with others so they can use the service. The sharing of information obtained through your subscription service will be cause to immediately terminate you subscription without a refund.

You may not modify the material as it is presented.

Material posted to any forum controlled by The Network Collective may be removed at any time if it is found to be in violation of copyright, trademark, or other intellectual property law.

Community Standards

The Network Collective may terminate your use of the service at any time if we believe you are acting, or have acted, in a way that negatively impacts The Network Collective, or another subscriber to the service. The Network Collective does not tolerate rasicm, sexism, bullying, or other unethical behavior on our service. Specifically, users may not—

  • Transmit any Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, offensive, obscene, pornographic, lewd, lascivious, or otherwise objectionable, as determined by The Network Collective.
  • Use a name or language that The Network Collective, in its sole discretion, deems offensive.
  • Post defamatory statements.
  • Post hateful or racially or ethnically objectionable content.
  • Post Content which infringes another’s copyright, trademark or trade secret.
  • Post unsolicited advertising or unlawfully promote products or services.
  • Harass, threaten or intentionally embarrass or cause distress to another person or entity.
  • Impersonate another person.
  • Promote, solicit, or participate in any multi-level marketing or pyramid schemes.
  • Exploit children under 18 years of age.
  • Engage in disruptive activity such as sending multiple messages in an effort to monopolize the forum.
  • Introduce viruses, worms, Trojan horses and/or harmful code to any community forum.
  • Invade the privacy of any person, including but not limited to posting personally identifying or otherwise private information about a person without their consent (or their parent’s consent in the case of a child under 13 years of age).
  • Solicit personal information from children under 13 years of age.
  • Violate any federal, state, local, or international law or regulation.
  • Encourage conduct that would constitute a criminal or civil offense.

Suitability of Use

The Network Collective is both a community and a training service. These services are provided as-is, in good faith, with the expectation that they will be helpful both to our paid subscribers and free users. However, it is possible that you do not, ultimately, find these services useful, or you find consequential or inconsequential mistakes in the material as provided. On being notified of such mistakes, The Network Collective will attempt to correct the mistake or remove the mistaken material from the service.

Your sole remedy in the case of such mistakes, or disagreement over such material, is to stop using the service provided.

Links to third parties are provided as a convenience to our users; The Network Collective does not guarantee the completeness, validity, or usefulness of any material linked to from the site, or any managed forum.

Indemnification

You will indemnify, defend and hold us harmless, at your expense, against any third-party claim, suit, action, or proceeding (each, an “Action”) brought against us (and our officers, directors, employees, agents, service providers, licensors, and affiliates) by a third party not affiliated with us to the extent that such Action is based upon or arises out of (a) unauthorized or illegal use of the Subscription Service by you, (b) your noncompliance with or breach of this Agreement, (c) your use of Third-Party Products, or (d) the unauthorized use of the Subscription Service by any other person using your User information. We will: notify you in writing within thirty (30) days of our becoming aware of any such claim; give you sole control of the defense or settlement of such a claim; and provide you (at your expense) with any and all information and assistance reasonably requested by you to handle the defense or settlement of the claim. You shall not accept any settlement that (i) imposes an obligation on us; (ii) requires us to make an admission; or (iii) imposes liability not covered by these indemnifications or places restrictions on us without our prior written consent.

What personal data we collect and why we collect it

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Contact forms

Contact forms are used for private communication between our users and the administrators of the site. These forms will collect the name, email address, website address, company name, and original message written by the user. This information is stored indefinitely and is used exclusively for the purposes of the initial user request. This information is never shared with anyone or used for marketing purposes.

Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

Embedded content from other websites

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracing your interaction with the embedded content if you have an account and are logged in to that website.

Analytics

We use Google Analytics to collect information about use of this site. Google Analytics collects information such as how often users visit this site, what pages they visit, and what other sites they used prior to coming to this site. We use the information we get from Google Analytics only to improve this site and our services. Google Analytics collects only the IP address assigned to you on the date you visit this site, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit this site, the cookie cannot be used by anyone but Google.

Data Collected to Manage Your Membership

At checkout, we will collect your name, email address, username, and password. This information is used to setup your account for our site. If you are redirected to an offsite payment gateway to complete your payment, we may store this information in a temporary session variable to setup your account when you return to our site.

Your name and email address are stored for the purposes of ongoing communication about your membership status as well as general announcements regarding the services you subscribe to. This information is stored with our third-party mailing list MailChimp and is stored with them indefinitely.

At checkout, we may also collect your billing address and phone number. This information is used to confirm your credit card. The billing address and phone number are saved by our site to prepopulate the checkout form for future purchases and so we can get in touch with you if needed to discuss your order.

At checkout, we may also collect your credit card number, expiration date, and security code. This information is passed to our payment gateway to process your purchase. The last 4 digits of your credit card number and the expiration date are saved by our site to use for reference and to send you an email if your credit card will expire before the next recurring payment.

When logged in, we use cookies to track some of your activity on our site including logins, visits, and page views.

Who we share your data with

Beyond the services detailed in this document, and for the purpose of enhancing your experience with our site and services, we do not in any way share or sell your personal information to any third party.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.
